Shipping Policy
This Trade Shipping & Risk Policy applies to all trade transactions conducted by Angelo(™) (“Company”, “we”, “us”, “our”), including but not limited to galleries, curators, interior designers, corporate buyers, and other professional purchasers (“Trade Client”).

Scope of Services

Angelo(™) arranges international and domestic shipment of artworks through reputable third-party carriers and specialist fine-art logistics providers.
Shipping may include, where applicable:
• Professional art packing
• Museum-grade crating (where required)
• Freight coordination (air/road/sea)
• Export documentation support
• Customs coordination
• Delivery to final destination
All logistics services are arranged on behalf of the Trade Client.

Shipping Charges
1
Shipping is charged separately unless expressly stated otherwise in writing.
Shipping fees may include:
• Collection and handling
• Packing and/or crating
• Freight charges
• Documentation support
• Insurance (if selected)
• Local delivery
Shipping fees become non-refundable once packing or shipment booking has commenced.

Packing Standards
1
ANGELO(™)uses professional packing standards appropriate to the artwork’s medium, size, fragility, and destination.
Depending on the artwork, packing may include:
• Protective wrapping and surface protection
• Corner and edge reinforcement
• Rigid board support or travel framing
• Moisture-resistant layers
• Custom crating with internal cushioning
The Company reserves the right to mandate crating for fragile, glazed, sculptural, high-value, or long-haul international shipments.

Title and Transfer of Ownership

Title (legal ownership) to the artwork transfers to the Trade Client only upon receipt of full cleared payment. Until full payment is received, Angelo(™) retains full legal title to the artwork.

Risk of Loss
1
For all Trade / B2B transactions:
Risk of loss, damage, delay, misplacement, or destruction transfers to the Trade Client upon dispatch, defined as the moment the artwork is handed over to the designated carrier or logistics provider.
From that point forward, transit risk lies with the Trade Client, subject to any insurance policy purchased.

Insurance
1
Insurance coverage may be arranged upon request and is strongly recommended for all shipments.
Important:
• Carrier liability is typically limited and may not reflect the full value of the artwork.
• Transit insurance, if arranged, is governed by the insurer’s policy terms, exclusions, deductibles, and claim procedures.
Where insurance is purchased, claims for loss or damage must be made in accordance with the insurer’s or carrier’s terms. Angelo(™) will reasonably assist in providing documentation necessary for claims (including invoices, packing confirmation, and dispatch details), but shall not be liable for claim outcomes. If the Trade Client declines insurance, all transit risk remains with the Trade Client.

Delivery Timelines

Delivery timelines are estimates only and are not guaranteed.
Angelo(™) shall not be liable for delays arising from:
• Carrier scheduling or network disruptions
• Customs clearance processes
• Government inspections or regulatory holds
• Weather, force majeure events, or other circumstances beyond reasonable control
Failure of delivery within estimated timeframes does not constitute breach of contract.

Customs, Duties & Import Charges

The Trade Client is solely responsible for:
• Import duties
• VAT/GST
• Customs brokerage fees
• Local taxes
• Regulatory compliance in the destination country
If a shipment is delayed, returned, abandoned, or destroyed due to failure to pay duties or provide required documentation, the Trade Client remains responsible for all related costs.

Inspection and Claims Procedure

Upon delivery, the Trade Client must:
• Inspect packaging before acceptance.
• Note visible damage on the carrier’s delivery receipt.
• Retain all packaging materials.
Any visible damage must be reported in writing within 48 hours of delivery with supporting photographic evidence. Failure to notify within this timeframe may prejudice the ability to pursue a carrier or insurance claim.

Limitation of Liability

To the maximum extent permitted by law:
• Angelo(™)’s liability shall not exceed the invoiced purchase price of the artwork.
• Angelo(™) shall not be liable for indirect, incidental, consequential, reputational, or business interruption losses arising from shipping delays, transit damage, customs holds, or loss in transit.
Angelo(™) acts as a logistics coordinator and arranger of shipment services but is not a carrier.

Force Majeure
1
Angelo(™) shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:
• Natural disasters
• War or civil unrest
• Government action
• Pandemics
• Strikes
• Transportation network failures

Governing Law
1
This Shipping Policy shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or in connection with this Shipping Policy shall be subject to the exclusive jurisdiction of the courts at New Delhi, India.

Miscellaneous

All parties agree that all shipping, delivery, risk, and logistics-related matters shall be governed by Angelo’s Shipping Policy, available at www.angeloart.ae which is deemed to be incorporated into this Agreement by reference.
